According to Section 138 of the Negotiable Instrument Act, the dishonour of a cheque is a criminal offence that is punishable by imprisonment for two years or with a monetary penalty or with even both. If the payee decides to proceed legally, then the drawer can be given a chance of repaying the cheque amount immediately.
